TERMS AND CONDITIONS

1. In all areas where "Harrison Rose" or "HRPD" is referred to this is in relation to "Harrison Rose Painting & Decorating Limited".
2. On acceptance of this estimate you are agreeing to our payment terms of 2.1: Below £500: 100% balance on completion, 2.2: Over 500 up to £5,000: 25% on confirmation of works, 25% on commencement of works, 50% (balance) on completion, 2:3: Over 5,000: 25% on confirmation of works, 25% on commencement of works, 25% stage payment (to be specified by Harrison Rose), 25% (balance) on completion. Payment terms still apply to staged works. Advance notice of payment dates to be sent to customer via email. All initial payments are non-refundable if less than 21 days’ notice given of cancellation. On confirmation, this estimate will the serve the purposes of the contract between HRPD and the customer and the works agreed.
3. All balances due to be paid within 5 working days of job completion as per estimate. Payments received after this time may be charged a standard rate of interest.  
4. All payments to be made as per payment information provided on invoice.
5. Any additional works requested will be added to the original amount for the works and a revised payment schedule will be issued as per our payment terms stated in point 2.
6. Start date to be agreed via email between customer and Harrison Rose. Harrison Rose to provide estimate of completion date to works and to endeavour to adhere to this date to the best of its ability. Harrison Rose will not be liable for any reasonable delays and will keep customer notified of any changes.  
7. The customer has the right to cancel this agreement within 21 days prior to the scheduled start date for the works. If the customer wishes to do so, they must inform Harrison Rose in writing to info@hrpainting.co.uk. If cancellation is made within less than 21 days the initial payment will be non-refundable and Harrison Rose may be compensated for any reasonable out of pocket expenses incurred (if applicable and not covered by sum of initial payment).  
8. Work to be done as specified, in a professional manner, to normally accepted industry standards. Harrison Rose are not responsible for acts of god, unavailable materials, work stoppages, pandemics, riots, mischief, or thefts; which are outside of Harrison Rose's control.  
9. All surface preparation, coating application, and/or installation shall meet or exceed industry standards. You are hiring an experienced company. Elements of the job will meet or exceed normal accepted practices in the industry.  
10. Harrison Rose warrants that all materials will be of standard or above quality. Labour is warranted for a period of one (1) year. All product warranties (where applicable) will be extended to customer upon payment in full for work completed. Harrison Rose’s liability under a warranty claim shall not exceed the total price charged for the work performed. Customer shall make warranty claims immediately upon discovering defect or performance problem. In the event that the substrate or any prior coating fails beneath what Harrison Rose has installed and/or applied, then Harrison Rose will not be held liable for the failure of the substrate or any coating. Failure to comply with the terms, conditions, and payment schedule of this agreement will void all warranties. 
11. All materials will be applied and/or installed according to the manufacturer’s specifications.  
12. Paint supplied (if applicable) to be Dulux and applied in two coats as standard unless otherwise specified and to include up to two colours per room. Any alternative brands (e.g. Farrow & Ball, Little Green, Fired Earth) or additional colours will be subject to an additional charge. Any additional coats required by the customer, if not stated on the estimate, will be at an additional charge to the customer.
13. Customer agrees and understands that access to the jobsite must be provided between 8am and 5pm, Monday through Friday (with the exclusion of public holidays), for the duration of this job. If at any time access is not available to Harrison Rose for any reason, the customer agrees to reimburse Harrison Rose for expenses incurred (if applicable) for travel and lost time at the rate of £25 per man-hour, and £0.25p per mile per vehicle. Access on weekends and public holidays may be requested and will subject to pre-agreed authorisation from the customer. 
14. Customer will assume responsibility to remove from any and all work areas, all household and personal items, and store those items away from the work area during the duration of the job. Harrison Rose will not be held liable for damage to any items not removed from the work area. Any items remaining in the work area and moved by Harrison Rose may be subject to a charge of £25 per man-hour for moving these items. Harrison Rose will not be held liable for any damage caused by moving any items.
15. Due to insurance regulations and safety procedures, the customer, other contractors, workers, children, pets, and individuals will not enter the work area unless agreed upon by both Harrison Rose and the customer. If other contractors, workers, children, pets, or individuals are to be present during the duration of the scope of work, the customer shall not schedule or permit such activities that will interfere with or prevent the timely and successful completion of the work. Harrison Rose shall not be held liable for any damage caused to its work by anyone other than Harrison Rose and its employees or representatives. The customer agrees to compensate Harrison Rose at the rate of £25 per man-hour to correct all such damage. 
16. Mould/fungus is a naturally occurring organism that we as Harrison Rose have no control over; Harrison Rose will not be liable for recurrence/growth of any form or type of mould/fungi. 
17. The customer agrees to complete feedback online, or via a feedback card provided by Harrison Rose, to Checkatrade – a directory of recommended and trusted tradesmen. 
18. The customer authorises Harrison Rose to display a sign for the duration of the job, and to use photographs taken at the jobsite for display, promotion, and advertising, without compensation to the customer. The customer must notify Harrison Rose prior to commencement of the works via email at info@hrpainting.co.uk if they do not give permission for this. This section will be void if not allowed by covenants or restrictions. 
19. The estimate provided is a best guess estimation on the cost of labour (where applicable) and materials (where applicable) for the works to be undertaken. Harrison Rose endeavours in all cases for the estimate presented to be an accurate indication of final and all costs for the work to be carried out (as presented). In the rare event that the works estimated may incur additional unforeseen costs Harrison Rose will notify the customer in person or in writing. 
20. This contract may only be changed in writing. Additional work performed (should this be required) may be subject to an extra charge, above the total price stated within the scope of this agreement. Additional work to be approved by customer prior to commencing, by signature, on a Change Order form. 
21. Upon substantial completion of work, the customer agrees to conduct an inspection of the work with Harrison Rose. All defects and uncompleted items should be noted at this time. The inspection must occur under normal lighting conditions, without magnification, and from a normal viewing position, in accordance with the industry standards.
22. All customer data will not be shared with any third parties. 
23. If this estimate has been supplied remotely, any variation to the works stated by the customer or discovered by Harrison Rose upon inspection of the site (if relevant) will incur an additional charge.
24. We cannot guarantee following the stripping of wallpaper that walls or ceilings will not require plastering. The full condition of the surface does not become apparent until stripping has been undertaken, If plastering is required and it has not been included in the estimate, any plastering will be undertaken at an additional cost to the customer, by Harrison Rose (if possible) or by a plastering company contracted by the customer.
25. If a colour matching service is requested, please note that we cannot guarantee how closely the final result will match the desired colour. Any colour matching services requested, therefore, will be at the customers own risk and Harrison Rose cannot be liable for any colour variations. 
26. In a situation where a dispute may occur during works and there is a breakdown in relationship, either party may terminate the contract, so long as all monies for work undertaken have been paid to date. Harrison Rose must also be compensated for any out of pocket expenses as a result of the contract being terminated.
27. We do not accept responsibility for any cracks that may appear after works have been completed or are due to movement or subsidence.
28. All works will be carried out by Harrison Rose in accordance with government guidelines (as current at the time) relating to the COVID-19 pandemic. Customers must isolate to an alternative area of the property throughout the duration of the works and must notify Harrison Rose immediately (and prior to arriving onsite), if experiencing any symptoms or having knowingly been in contact with someone who has the virus.
